General Terms and Conditions
1. Scope of application
-
These General Terms and Conditions (GTC) apply to all contracts for coaching services between heart.voyage (hereinafter “Provider”) and the customer (hereinafter “Customer”), which are concluded via the website bab.coach.
2. Subject matter of the contract
-
The provider offers coaching services that are carried out in individual or group sessions. The exact content, duration and prices of the coaching sessions are described on the provider's website.
-
The coaching sessions are conducted online via the Zoom video conferencing platform. The customer is responsible for meeting the technical requirements for participation.
3. Conclusion of contract
-
The presentation of the coaching services on the provider's website does not constitute a legally binding offer, but an invitation to place an order.
-
By clicking on the “Book now” button, the customer submits a binding offer to conclude a contract. The provider confirms receipt of the order immediately by e-mail. The contract is concluded upon receipt of the confirmation e-mail.
4. Terms of payment
-
The prices stated on the website are final prices and include the statutory value added tax.
-
Payment shall be made via the payment methods specified by the provider (e.g. PayPal, credit card). The total amount is due upon conclusion of the contract.
5. Right of withdrawal
-
The customer has the right to withdraw from the contract within 14 days without giving any reason.
-
In order to exercise the right of withdrawal, the customer must inform the provider by means of a clear statement (e.g. by letter or e-mail) of his decision to withdraw from this contract.
-
In order to comply with the withdrawal period, it is sufficient for the customer to send the notification of the exercise of the right of withdrawal before the expiry of the withdrawal period.
-
If the customer requests that the service should begin during the withdrawal period, the right of withdrawal expires when the service has been fully provided.
6. Data protection
-
The Coach collects and processes personal data of the Client exclusively for the purpose of processing the contract and in compliance with the statutory data protection regulations, in particular the GDPR.
-
The Coach will not pass on any personal data to third parties unless this is necessary for the fulfillment of the contract or the Coach is legally obliged to do so.
7. Consent through online purchase
-
By clicking on the “Book now” button or a similar button on the provider's website, the client declares his or her fully informed consent, acknowledgement and agreement to the information set out above and the General Terms and Conditions.
8. Final provisions
-
The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
-
Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
-
Place of performance and jurisdiction for all disputes arising from contractual relationships between the provider and the customer is the registered office of the provider, provided that the customer is a merchant, a legal entity under public law or a special fund under public law.
